Iam Properties demands nearly £400k from fast food chain for failing to keep property in good repair
A row between fast food restaurant chain McDonald’s and shop owners Iam Properties has boiled over into the High Court.
Iam Properties accuses McDonald’s of breaching the lease of premises in Golders Green Road, London NW11, and is demanding damages of £390,000.
McDonald’s took a twenty five and a half year lease of the premises from June 24 1981, but breached the lease by failing to keep the property in good repair, according to a High Court writ.
McDonald’s also failed to hand back the property in good and substantial repair and condition, to remove its trade fixtures and fittings, and failed to paint the inside, the writ claims.
Iam Properties, of High Street, Colliers Wood, London, says it has suffered losses totalling £390,000, including the cost of building work, preparing and serving a schedule of dilapidations, and loss of rent while work is carried out.
Now the company is seeking damages for breach of covenant.
