Dukeminster vs Tesco Stores

Property developer Dukeminster has launched proceedings over the status of a piece of land it has proposed building a road on, that Tesco maintains it owns.

Dukeminster wants to build a road in Devon between Old Rydon Lane and the A379 to provide access to a one of its developments. It says the land has adopted 鈥減ublic highway status鈥, which mean Devon council and the Highways Agency can allow it.

Tesco, which owns a large store and petrol station near by, says it owns the land and has the right to choose who can use it.

The parties are seeking a High Court decision on the case.

Stewart Milne Group vs Protex Corporation

Housebuilder Stewart Milne Group is suing construction company Protex Corporation in a row over work at Canvey Island in Essex.

Stewart Milne, trading as Stewart Milne Timber Systems, carried out work for Protex, and the two companies entered into a settlement agreement in June this year, according to a High Court writ.

Stewart Milne now accuses Protex of failing to make proper payment and is claiming 拢110,000.

Half of the money should have been paid within 28 days of signature and the rest when a part D document was issued by the NHBC, the writ says. Stewart Milne is also seeking interest.
